These Terms & Conditions ("Terms") are a binding agreement between you and Tonerelo, a brand of The Nelson M Group LLC ("Tonerelo," "we," "us"). They govern your use of tonerelo.com and related services, including email and text-message programs (the "Services"). By using the Services or submitting a form, you agree to these Terms, our Privacy Policy, and, if you opt in to texts, our SMS Terms. If you do not agree to them, you should not use the Services.

Tonerelo is an information service. We publish general, plain-language data about health and beauty topics, and let visitors opt in to related updates. We do not sell products or treatments, make medical claims, give medical advice, diagnose or treat any condition, match people with clinicians, retailers, or service providers, or refer people to providers, and we do not share your details with clinicians, retailers, or any other business partners.

• Decisions about your skin, hair, body, and routine are yours. Reading our content does not obligate you to do anything.
• The clinician, retailer, or brand you deal with, not Tonerelo, sets its own products, prices, and advice and is responsible for its own work and decisions.
• Skin, hair, products, and results vary from person to person. We never guarantee that any habit, ingredient, or product will work, cost or save any amount, or turn out any particular way.

You must be at least 18 years old, located in the United States, and able to form a binding contract to use the Services. You may only submit information about yourself, or about another person who has authorized you to do so.

You promise that what you submit is accurate and up to date, and you will update it if anything changes. The mobile number you enter must be one you own or have authority to use. If your number changes or is reassigned, please reply STOP from the old number or contact us so that we do not message someone else.

If you opt in, you agree that we may contact you by email and, if you check the applicable boxes, by automated text messages as described in the SMS Terms. Consent to texts is optional, is not a condition of purchase or of using the Services, and may be withdrawn at any time by replying STOP. Message frequency varies. Message and data rates may apply. Prohibited conduct includes: (a) false, misleading, or third-party details; (b) unlawful, fraudulent, or abusive use; (c) interference with the Services or unauthorized access attempts; (d) bots or automated form submission; (e) copying, scraping, or reselling content without permission; and (f) impersonation. We can suspend or end your access if you engage in any of it.

Organizations, programs, and products mentioned on or linked from the Services (for example government agencies, manufacturers, or nonprofit organizations) are run by third parties. We do not endorse any product, brand, or provider and are not responsible for the conduct, content, or results of third parties. Your relationship with a retailer, brand, or health professional is between you and them.

The Services, including the Tonerelo name, logo, text, graphics, and design, are owned by us or our licensors and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view and use the Services for personal, non-commercial reasons.

We supply the services and all content "as is" and "as available" and disclaim all warranties, express or implied, among them implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We will not warrant uninterrupted, error-free, or secure operation, or the delivery (or timely delivery) of any message.

Tonerelo does not provide medical, professional, legal, or financial advice, and makes no representation about any product, ingredient, result, or health outcome.

As far as the law allows, Tonerelo and The Nelson M Group LLC, and their members, managers, officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the services, or from any health, beauty, or product decision you make or do not make. Our total liability for any claim relating to the services will not exceed one hundred U.S. dollars ($100).

Not every jurisdiction allows these limitations, and some of them may therefore not apply to you. No provision of these Terms limits liability where the law forbids limiting it.

You agree to hold The Nelson M Group LLC, its affiliates, and its personnel harmless, and to indemnify them, for claims, damages, and expenses (reasonable attorneys' fees included) arising from your violation of these Terms, from misuse of the Services, or from giving a phone number or other information that you were not authorized to offer.

Informal resolution first. Before you file any claim, reach us at [email protected] so that we have 30 days to try to resolve it.

Binding arbitration. Apart from small-claims matters and injunctive-relief claims over intellectual-property misuse, every dispute between you and Tonerelo or The Nelson M Group LLC arising from or relating to these Terms or the Services shall be resolved through final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. At your choice, the arbitration is held in your county of residence or by video or phone. An arbitrator may award the same individual relief as a court, and judgment on the award might be entered in any court with jurisdiction.

Class-action waiver. You and Tonerelo each waive, to the extent the law permits, any right to bring claims as a plaintiff or class member in a class, collective, or representative action; claims may be brought on an individual basis only.

Opt-out. Within 30 days of first accepting these Terms, you may decline arbitration by emailing [email protected] with "Arbitration Opt-Out" as the subject, and tell us your name and mobile number.

Governing law. These Terms are governed by the Federal Arbitration Act and to the law of the state of The Nelson M Group LLC's principal place of business, disregarding conflict-of-law rules. Other than as the arbitration clause provides, courts of that state, state and federal, have exclusive jurisdiction.

You may stop using the Services at any time, and may opt out of messages by replying STOP. We may suspend or end your access at our discretion, including if you violate these Terms. Any section that by its nature should continue (such as disclaimers, limitation of liability, indemnification, and disputes) will survive termination.

From time to time we may update these Terms and will post the update with a new "Last updated" date. By continuing to use the Services after the effective date you accept the updated Terms. Notice of material revisions will be provided where mandated by law.

These Terms, together with the Privacy Policy and SMS Terms, are the entire agreement between you and us on this subject. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent, and we may assign them in connection with a merger or sale of the business.
